Are stun guns legal in New Jersey? Yes — stun guns and TASER devices are legal for civilian purchase, possession, and carry in New Jersey. The state enforced a total ban on these devices from 1985 until October 2017, when a federal court ruled the ban unconstitutional under the Second Amendment following the U.S. Supreme Court's decision in Caetano v. Massachusetts. New Jersey's Attorney General agreed to lift the ban via consent decree, and regulations took effect January 2, 2018. No permit, firearms identification card, or background check is required to purchase or possess a stun gun.
New Jersey Stun Gun Rules
- No Permit Required: You do not need a Special Carry Permit, Firearms Purchaser Identification Card (FID), or any other state credential to purchase, possess, or carry a stun gun in New Jersey.
- Age Requirement: You must be 18 or older to purchase or possess a stun gun. No person under 18 may possess a stun gun — any stun gun possessed by a minor is subject to confiscation by law enforcement.
- Prohibited Persons: Individuals classified as "Certain Persons" under New Jersey law — including convicted felons, those with domestic violence convictions, and others barred from firearm ownership — are also prohibited from possessing stun guns.
