Are stun guns legal in Massachusetts? Yes โ civilian ownership and use of stun guns and Taser-style devices has been legal in Massachusetts since 2018. Following the Massachusetts Supreme Judicial Court's ruling in Ramirez v. Commonwealth (2018), which struck down the state's total ban as unconstitutional, Massachusetts integrated stun guns into its existing firearms licensing framework rather than prohibiting them outright.
Massachusetts Licensing Requirements
Stun guns are regulated as firearms under M.G.L. Chapter 140, ยง 131J. The key requirements are:
- License to Carry (LTC) Required: To legally purchase or possess a stun gun in Massachusetts, you must hold a valid License to Carry (LTC). A Firearms Identification (FID) Card alone is not sufficient โ the Massachusetts Firearms Records Bureau has confirmed that FID card holders may not purchase or possess stun guns. An LTC is the only qualifying credential.
- LTC to Carry Outside the Home: Even if you legally own a stun gun, carrying it in any public space requires an LTC. An FID does not authorize public carry under any circumstances.
- Licensed Dealer Purchases Only: Stun guns must be purchased through a licensed firearms dealer. Private sales are prohibited. Dealers are required to verify your LTC, record the transaction, and conduct a background check at the point of sale. This applies to online purchases as well โ out-of-state online retailers must comply with Massachusetts licensing and transaction regulations.
- Minimum Age: You must be 21 or older to obtain an LTC, which is the only license permitting stun gun ownership.
- Storage Requirements: Under M.G.L. c. 140, ยง 131L, stun guns must be stored in a securely locked container when not under your direct physical control.
- Prohibited Carry Locations: Even with a valid LTC, carrying a stun gun is prohibited in K-12 schools, college campuses, courthouses, government buildings, and airport secure areas.
Pending Legislation (H2615)
A proposed bill, House Bill H2615, would significantly loosen Massachusetts stun gun requirements โ potentially allowing any non-prohibited adult 18+ to own a contact stun gun without a firearms license, and adults 21+ to carry a projectile device. However, this bill has not passed as of June 2026 and has no guaranteed timeline for becoming law. Current LTC requirements remain fully in effect until and unless this legislation is enacted.
