Is pepper spray legal in New York? Yes โ pepper spray is legal to possess and use for self-defense in New York State under NY Penal Law ยง 265.20(a)(14). However, New York enforces one of the strictest distribution laws in the country: out-of-state online retailers cannot ship standard human-use pepper spray directly to New York addresses. Purchases must be made in person from a licensed firearms dealer or registered pharmacist.
New York Pepper Spray Laws โ What Buyers Need to Know
- In-Person Purchase Only: Human-use pepper spray may only be sold by a licensed firearms dealer or registered pharmacist in New York. Out-of-state online retailers โ including TBOTECH โ cannot ship standard pepper spray to New York residential addresses under current law.
- 0.75 oz Size Limit: Under New York Department of Health regulations (10 NYCRR Part 54, Section 54.3), canisters must contain no more than 0.75 oz net weight. The active ingredient must be oleoresin capsicum only, at no more than 0.7% total capsaicinoids by weight. Standard keychain and pocket models in OC formula are legal. Large tactical canisters are not.
- Required Label: Every lawful canister must carry a warning label stating the device is intended solely for self-defense, along with first-aid information and a toll-free number for self-defense training resources.
- Age Requirement: You must be 18 or older to purchase or possess pepper spray in New York.
- Prohibited Persons: Possession is illegal for anyone convicted of a felony or any assault crime in New York or any other state.
- Sworn Statement Required at Purchase: Before completing a sale, the licensed dealer must require proof of age and a signed statement confirming the buyer has not been convicted of a felony or assault. No more than two units may be sold to a single buyer at one time.
Pending Legislation โ S4922A
A bipartisan bill sponsored by State Senator Jessica Scarcella-Spanton and Assemblymember Chris Eachus (S4922A) would eliminate the ban on shipping pepper spray to New York addresses and open sales beyond licensed dealers and pharmacists. The bill has advanced through multiple amendments as of July 2026 but has not passed into law. Current restrictions remain in effect until and unless this legislation is enacted.
