Are stun guns legal in Illinois? Yes — handheld stun guns and Taser-style devices are legal for civilian purchase, ownership, and self-defense in Illinois. In 2019, the Illinois Supreme Court ruled unanimously that the state's ban on carrying Tasers and stun guns in public violated the Second Amendment. Illinois requires a Firearm Owner's Identification (FOID) card to purchase or possess a stun gun — the same card required for firearms.
The FOID Card Requirement
Under 430 ILCS 65/2, a valid FOID card is required to purchase or possess any stun gun or Taser in Illinois:
- FOID Card Required: You must hold a currently valid Illinois Firearm Owner's Identification Card issued by the Illinois State Police to purchase or possess any electronic stun device.
- No Separate CCL Required to Carry: The Illinois Supreme Court confirmed that stun guns and Tasers are not covered under the state's concealed carry licensing laws. A valid FOID card is sufficient to carry a stun gun — you do not need a separate Concealed Carry License (CCL). Note that Chicago may have additional local requirements (see Chicago section below).
- Age Requirements: You must be 21 or older to independently apply for a FOID card. Adults aged 18–20 may obtain a FOID card only with written consent from a parent or legal guardian who is themselves FOID-eligible.
- 24-Hour Waiting Period: Illinois law requires a 24-hour waiting period between purchase and taking possession of a stun gun or Taser. A background check is conducted at point of sale. This affects shipping timelines for online orders.
- Vehicle Transport: When transporting a stun gun in a vehicle, it must be unloaded and enclosed in a case, or otherwise immediately inaccessible. Keeping it within reach in a center console or glove box does not meet this standard.
- Prohibited Persons: Possession is illegal for anyone with a felony conviction, certain domestic violence offenses, or other disqualifying factors under state or federal law.
Where Stun Guns Are Prohibited — Even With a FOID
Under 720 ILCS 5/24-1, carrying a stun gun in the following locations is illegal regardless of FOID status:
- K-12 school buildings, grounds, buses, and school-sponsored events
- Public transportation vehicles and stations (CTA, Metra, etc.)
- Government buildings, courthouses, and municipal offices
- Establishments that sell alcohol
- Public gatherings requiring a license or charging admission
- Airport secure areas past TSA screening checkpoints
- Private businesses posting legally recognized "No Weapons" signage
Chicago-Specific Rules
Chicago residents should be aware that the city has historically maintained stricter weapons ordinances than state law. While the 2019 Illinois Supreme Court ruling applies statewide, Chicago's municipal code may impose additional restrictions on stun gun carry or possession. If you are in Chicago or Cook County, verify current local ordinances with the Chicago Police Department or a local attorney before carrying a stun gun in public.
